Terms and Conditions of Use

1. Terms

These Terms are the rules for using the RaceHero application and website (referred to as “service” or “services”). If you are using the services, then it means that you agree to everything in these Terms. You must be, at least, 18 years old and willing to be legally bound by these Terms. If you do not agree to anything in these Terms, then your only solution is to avoid using any of the services.

2. Copyright

Everything including on any RaceHero service is property of RaceHero and protected by Copyright laws. This includes words, sound clips, software, and any images in the services.

We respect everybody’s intellectual property. If you believe that we are infringing your copyright in any way, please send see our Copyright Notice for information on how to file a complaint.

3. Use License

You are free to use any RaceHero service for your own use, but you cannot use it to make money for your or any business. You only have a license to use these services and you do not have any ownership rights to any services or anything contained in them. This license only applies to you and you cannot give it to anybody else. Specifically, you cannot:

1. modify or copy the materials;
2. use the materials for any commercial purpose without prior written permission from Hagerty Group, LLC;
3. attempt to decompile or reverse engineer any software contained on RaceHero;
4. remove any copyright or other proprietary notations from the materials; or
5. transfer the materials to another person or "mirror" the materials on any other server.

If you break any of these rules, your license to use any of these services is automatically terminated. We can also terminate your license any time for other reasons. When you are done using the RaceHero services, you must destroy any RaceHero materials that you have or control.

4. Disclaimer

Any materials provided on the RaceHero services are “as is”. We try our best, but we cannot guarantee that these materials will be perfect for any use that you intend, or in perfect working order, or that they do not violate some right of somebody. We also cannot guarantee that any materials are error-free or perfectly reliable.

5. Limitations

RaceHero and its suppliers will never be responsible for any damages or loss that your claim. This includes any lost profits, lost data, or any other incidental or consequential loss. These limitations apply even if we were notified that the loss might happen. Some jurisdictions do not allow these limitations, so depending on where you are located, these limitations may not apply to you.

6. Revisions and Errors

We include a lot of information in the RaceHero materials. It is possible that these materials could have some sort of technical, typographical, photographic, or other types of errors. While we do try out best, we do not guarantee that all of our materials are perfectly accurate, complete or current. We may update them from time to time without notifying you. But we do not promise that we will make updates, either.

7. Links

This website has links to other sites. We may not own those other websites. If we do not own them, then we cannot be responsible for anything that happens there. Please be careful on the internet. Just because we have a link to a website does not mean that we endorse that website, nor do we claim that it is secure.

8. Site Terms of Use Modifications

RaceHero may revise these Terms of use for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

9. Governing Law & Dispute Resolution.

To the extent possible, Michigan law will apply to these Terms. By using these services, you agree to Michigan’s jurisdiction (subject matter and personal) and venue for any legal claim coming from these Terms or the use of the RaceHero services in courts located in Grand Traverse County Michigan or the Federal Western District of Michigan.

You also agree that in the event of any action to enforce or interpret these Terms, the prevailing party will be entitled to collect its reasonable attorneys’ fees.

Use of the RaceHero website is not authorized in any jurisdiction that does not give effect to all provisions of these Terms, especially including this paragraph.

You agree that any claim arising out of or related to these Terms or your use of the RaceHero website must be filed by you within one (1) year after such claim arose, or it is forever barred.

10. Assignment

RaceHero may freely assign its rights and obligations under these Terms and conditions to another party. If RaceHero does make an assignment, RaceHero may be relieved of any further obligation under these Terms.

11. Miscellaneous

If any portion of this Agreement is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver.
